The Town of Brookhaven has reached a decison concerning the ZBA applications made by Steven Spiliotis of the Miller Beach Club, Inc. and Miller Beach Surf Club, Inc. The 6 page decision can be viewed here. The Town granted its decisions:

"for all structures with stipulation that CATERING BE FOR MEMBERS ONLY
AS PER ORIGINAL CHARTER

The Miller Beach Surf Club, Inc. (MBSC) has operated as a Domestic Not-For-Profit Corporation since May 14th, 1942. On March 8, 2006, a lease agreement was entered into between the Miller Beach Surf Club, Inc. and Miller Beach Club, Inc. (MBC). The Miller Beach Club, Inc. (MBC) is a Domestic Business Corporation formed on October 21, 2005 by Steve Spiliotis of 54 Sands Lane, Port Jefferson, NY. The lease agreement extends through December 31, 2021.

In the event the above Lease Agreement is terminated before March 8, 2008 the Miller Beach Surf Club, Inc. (MBSC) shall pay Steven Spiliotis of the Miller Beach Club Inc. (MBC) the amount of $125,000.00 .The MBSC has a collateral mortagage in escrow until the 2 year period has passed (March 8, 2008).

The MBSC currently rents a house on the property to year round tenants. The income from the rental house is that of Steve Spiliotis (MBC). He also has the right to lease the house himself.

In 2001 the Miller Beach Surf Club (MBSC) featured (91) members, (24) of which were newly recruited. In 2006 the MBSC reported (30) beach and (30) social members.

The MBSC is currently booked for affairs year round through October, 2008. Among the deposits taken for 2007-2008 bookings were no less than (25) weddings. In 2001 the MBSC held (4) weddings. In 2002 the MSBC held (2) weddings.

Weddings are currently booked at the MBSC for 2007 and for 2008.

The MBC filed a NYS Application for Alcoholic Beverage Control Retail License on April 11, 2006 to: " operate as a Restaurant with hours of operation 12 p.m. to 2 a.m. all days - open to the public Tues., Weds., Thurs. , Sat. eves & Sun. eves. Friday eves 3/17 - 11/28 & approx. 20 other days in the year."

On April 19th, 2006 the Department of Law for the Town of Brookhaven served a Notice Before Summons to the Miller Beach Surf Club, Inc. (MBSC) for the violation of (5) Brookhaven Town Ordinances. The case is currently pending upon the decision reached by the Brookhaven Board of Zoning Appeals. The ZBA hearing is schedule for September 26, 2007 at 3:00 p.m.

By filing the Application for Building and Zoning Permit # 780892 The Miller Beach Club (MBC not the MBSC) is applying to correct recent violations as well as for a Certificate of Existing Use (CEU). The CEU would allow the continued non-conforming use of the property to include the operation of the MBSC as a catering facility.

A web site has operated since 2006 at www.millerbeachsurfclub.com . The site offers: "... catering facilities... Completely remodeled in 2006... we offer a variety of catering packages to suit any occassion... and can accommodate up to 120 guests.... Give us a call to discuss all the possibilities for your next affair." Featured on the home page is a bride and groom. The MBSC also advertised in newspapers throughout 2006 and 2007 boasting: " Come visit our fully renovated facility perfect for all catered events 40 to 120 people." The MSBC Fire Prevention Permits through 05/22/02 issued by the Town of Brookhaven state "OCCUPANCY BY MORE THAN 98 PERSONS IS DANGEROUS AND UNLAWFUL".The current maximum occupancy for the MBSC has been confirmed by the Town of Brookhaven Fire Marshall to be no more than 98 persons as of the issuance of the 2007 permit.

Harbor Beach Road is one of two roads traveled to Cedar Beach. Traffic patterns in the Summer and on all weekends are extremely busy. The additional traffic from the MBSC has included increased delivery trucks, outside workers, facility staff of the (MBC), and numerous guests attending events.

The Miller Beach Surf Club (MBSC) is located in a residential area just outside of the Miller Place Historic District. The nearest commercial zonings are located more than 1/4 of mile away on a main road ( North Country Rd.).

The MBSC property at 23 Harbor Beach Road is currently a property class 417 - Camps, Cottages, Bungalows - Usually rented on a seasonal basis. Lombardis of Port Jefferson, NY is as a property class 553 - Country Club.

The MBSC has private shares in the corporation. Members owning shares stand to profit from future MBSC capital gains. Numerous past and present MBSC members have recently written letters in support of the MBSC. Letters have been sent to members requesting they attend the Town of Brookhaven ZBA meeting on September 26, 2007. The majority of MBSC club members (past and present) due not live in the immediate vicinity of the property and thus will remain unaffected by potential changes in the adjoining area.

The Miller Place Civic Association has voted not to support the permit request of the MBSC.
